Baker Tilly partner Dr. Alexander Fridgen leads the proceedings as general agent

Munich, January 24, 2025 – Baker Tilly advises St.-Marien-Hospital gemeinnützige GmbH in Friesoythe in its restructuring under protective shield proceedings. Together with his restructuring team, Dr. Alexander Fridgen, attorney-at-law and partner at Baker Tilly, is guiding the company through the proceedings as general agent.

On January 23, 2025, an application for the implementation of protective shielding proceedings was filed for St.-Marien-Hospital at the competent district court in Cloppenburg. The hospital is to be made fit for the future while continuing operations. Hospital operations will continue in full; wages and salaries are legally secured.

The restructuring experts will now provide comprehensive on-site support for the implementation of the protective shield proceedings right from the start. With its interdisciplinary expertise and many years of experience in insolvency and reorganization law as well as restructuring and corporate planning, the team led by Dr. Alexander Fridgen offers the perfect know-how for St.-Marien-Hospital’s successful reorganization. Dr. Fridgen himself is established on the market as a renowned insolvency administrator, specialist lawyer for insolvency and restructuring law and specialist lawyer for banking and capital market law.

Dr. Alexander Fridgen says: “St. Marien Hospital is highly relevant for the region's health care structure. Furthermore, the hospital has already implemented substantive restructuring programs and has been promised support from the district. This puts St. Marien Hospital in a very good starting position to make the best possible use of the protective shield proceedings’ legal privileges for its repositioning and thus secure its long-term survival.”

As part of the St. Marien Stift Friesoythe, established in 1867, St. Marien Hospital plays a central role in medical care for the region around Friesoythe. In addition to basic and standard care, the hospital focuses on obesity, geriatric and addiction medicine. St. Marien Hospital is one of the largest employers in the region and plays an important economic role in Friesoythe and the surrounding area.

The reason for taking this step is the hospital’s liquidity squeeze which was triggered by the current health policy challenges in the German hospital landscape. As is the case for many hospitals in Germany, cost developments without adequate counter-financing require the hospitals to adapt to the circumstances in order to remain viable.

The Cloppenburg local court has appointed attorney-at-law Michael Waculik from Jever as provisional trustee
